Registering a Child's Birth When the Father or Mother is a Foreigner in Vietnam

Law on Civil Status 2014

Article 36: When one parent is a foreigner, the birth certificate must contain a written agreement on the child's nationality. If you choose foreign nationality → this document must be confirmed by the competent authority of that country. Article 15: The child must have his/her birth registered within 60 days from the date of birth.

Decree 158/2005/ND-CP on registration and management of civil status

Includes detailed regulations:

  • In case of birth outside a medical facility

In case of foreign elements:

  • The Commune People's Committee can resolve the matter if the parent legally resides in the locality

Vietnamese Nationality Law

If one parent is a Vietnamese citizen:

Process of Carrying out Birth Registration Procedures

Step 1: Prepare Documents

The person registering (usually the father or mother) prepares:

  1. Birth registration declaration form (standard form, can be downloaded from the National Service Portal).
  2. Birth certificate issued by the hospital. If giving birth at home → witness confirmation or written commitment.
  3. Marriage certificate (if any).
  4. Written agreement to choose nationality (required if there is a foreign element). If you choose foreign nationality → must be confirmed by the host country agency.
  5. Passport/ID card/CCCD of father and mother.
  6. Residence documents (permanent or temporary residence).
  7. Notarized translation of all foreign documents.
  8. Additional documents according to local requirements.

Step 2: Identify Competent Authority

1. Commune People's Committee (ward/commune/town)

Applicable when:

  • Parents (especially mother) reside locally
  • The application is simple and does not require international verification

2. Department of Justice of province/city

Applicable when:

  • One party is a foreigner who presents a foreign passport
  • Need to verify family or nationality information
  • The Commune People's Committee transferred the file because it exceeded its authority

Note: Jurisdiction is based on legal residence, not household registration.

Step 3: Submit Application

Parents can:

  • Submit directly
  • Authorize a lawyer or relative
  • Submit online application if implemented locally

The civil status office will:

  • Check the validity of documents
  • Compare translations and authenticate
  • Request additional items if missing

Step 4: Process & Verify Records

If the application is complete:

  • The civil status officer enters information into the civil status book and submits it for signature

If verification is needed:

  • Contact diplomatic agencies
  • Request additional documents
  • Clarify information about nationality, marriage, or residence

Processing time varies depending on locality but is generally relatively fast if the documents are standard.

Step 5: Get Results

Results include:

  • Original birth certificate
  • Personal identification number (if the child has Vietnamese nationality)
  • Copies upon request

If the child carries foreign nationality, maybe Personal identification numbers are not issued according to the Civil Status Law.
